The Federal Rules of Civil Procedure (FRCP) are a body of rules that govern court procedures for managing civil suits in the United States district courts.

These procedures were completely rewritten on December 1, 2007 making them easier to understand. Currently thirty five states have adopted the federal rules as their own procedural code. These rules are pretty specific and certainly non-negotiable!

The courts are not tolerant of organizations that have not implemented programs to accurately retrieve email. Just having a policy for storage is not enough. Companies must demonstrate they are followed at all levels. The penalties for failing to meet these guidelines can be harsh indeed!

There are no exceptions for company size, non-profit status, or foreign organizations. The FRCP applies to litigation that cross state lines and any court cases that involve federal regulations, such as workplace safety and discrimination. States are also starting to adopt the major provisions of the FRCP for state courts.
